Rights-of-WayA gas pipeline or plant secured by a right may also be used for the installation, operation and renewal of telecommunications lines. According to Section 76 of the German Telecommunications Act (Section 57 in former version of this Act), the owner of a property cannot prohibit the installation, operation and renewal of a telecommunications line on his property if the usability of the property is not additionally restricted on a lasting basis. Accordingly, the owner must allow the permitted installation to go ahead on the ROW secured by a right. The gas companies always seek amicable solutions with the property owners on the timing such work.
